terms of service – gazd
gazd exists because we don’t trust middlemen. the irony of asking you to agree to a legal document is not lost on us. it’s shorter than most. you’re welcome.
by using gazd you agree to these terms.
1. who can use gazd
you must be at least 12 years old to use gazd. if you’re under 18, you confirm that you’ve reviewed these terms with a parent or guardian and that they agree to them on your behalf.
2. what gazd is (and isn’t)
gazd is a local photo encryption utility. it runs entirely on your device. gazd does not:
- send your photos to us or to anyone else
- store your photos on any server
- have any servers at all
- collect analytics, account info, or personal data
- moderate, scan, or review the content you put into it
how you share sealed photos (native sharing, file attachments, etc.) is your decision and your responsibility. we never see what you encrypt or decrypt and never receive copies of any of it.
3. acceptable use
by using gazd, you agree that you will not:
- seal or share content you don’t own or don’t have permission to share
- create, share, or distribute illegal content of any kind — including but not limited to child sexual abuse material (CSAM), non-consensual intimate imagery, copyrighted material you don’t have rights to, or any content prohibited by law
- use gazd to harass, threaten, defraud, blackmail, or otherwise harm any person
- use gazd to evade legitimate legal obligations, court orders, or safety measures
- reverse-engineer, modify, or attempt to extract source code from gazd, except as expressly permitted by applicable law
you are solely responsible for the photos you seal, the people you share them with, and the consequences of those actions.
4. your content stays yours
you own everything you put into gazd. we never see it, store it, or claim any rights to it.
5. no warranty
gazd is provided “as is” and “as available.” we make no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation. we don’t promise gazd will work without errors, run on every future OS version, never crash, or successfully recover every sealed photo you create.
6. limitation of liability
to the maximum extent permitted by law, we are not liable for any damages — direct, indirect, incidental, special, consequential, exemplary, or otherwise — arising from your use of gazd, including but not limited to lost photos, lost data, miscommunication, embarrassment, or social or legal consequences of what you choose to seal and share. our aggregate liability to you for any claim arising from gazd will not exceed the greater of (a) what you paid us for gazd in the 12 months preceding the claim, or (b) ten US dollars.
7. indemnification
you agree to defend, indemnify, and hold harmless BrutalBytes and its developers, officers, and affiliates from any claim, demand, lawsuit, or expense (including reasonable attorney fees) arising from (a) your use of gazd, (b) your violation of these terms, or (c) your violation of any law or any third party’s rights.
8. changes to these terms
if these terms change, the version and date at the top of this page will reflect it. the app links to the live version — updates apply immediately, no app update required. if something material changes, we’ll say so clearly.
9. termination
you can stop using gazd at any time by deleting the app. we can stop providing gazd at any time, for any reason, without notice. sections 3, 5, 6, 7, 10, 11, and 12 survive any termination.
10. governing law and venue
these terms are governed by the laws of the State of Georgia, United States, without regard to its conflict-of-laws principles. any dispute arising from these terms or your use of gazd will be brought exclusively in the state or federal courts located in Georgia, and you consent to personal jurisdiction there.
11. severability
if any part of these terms is found unenforceable, the rest stays in full force and effect.
12. entire agreement
these terms, together with the Privacy Policy, are the entire agreement between you and us regarding gazd, and supersede any prior agreements.
